Article 1 (Overview)
These Terms and Conditions (these "Terms") set out the conditions of use for the Global Mobile Data Benefit (the "Offer") provided to eligible Hong Kong and Macau-issued Visa cardholders for the mobile data services offered by GigSky, Inc. ("GigSky"). The mobile data services under this Offer are provided solely by GigSky. Visa is not the provider of any mobile data services.
Article 2 (Definitions)
The key terms used in these Terms are defined as follows.
GigSky App: The dedicated application provided by GigSky for eSIM setup and mobile data usage.
eSIM: A digital SIM embedded in a device that does not require a physical SIM card.
GigSky Pass: The entitlement to use GigSky mobile data services within a specified data allowance and validity period.
Eligible Cardholder: An individual holding a Hong Kong or Macau-issued Visa card designated by Visa as eligible for this Offer.
Redemption: The act of claiming a GigSky Pass as an Offer Plan through the GigSky App.
Dormant Period: The waiting period between redemption of a GigSky Pass and its activation, during which data services have not yet commenced.
Activation: The point at which the eSIM becomes enabled for data connectivity and the validity period begins.
Validity Period: The period during which data services can be used following activation.
Article 3 (Offer Details)
3.1 Complimentary Global Mobile Data Benefit Eligible Cardholders may access the following complimentary data plans.
Visa Infinite Consumer payment cardholders, Visa Commercial, Business and Purchasing cardholders: 3GB, 15 days from activation. Additionally, an exclusive 30% discount on all GigSky plans.
Visa Platinum and Visa Signature Consumer payment cardholders: 1GB, 15 days from activation. Additionally, an exclusive 20% discount on all GigSky plans.
Visa Classic, Visa Gold, Visa Debit, Visa Prepaid cardholders: An exclusive 10% discount on all GigSky plans.
Article 4 (Dormant Period and Activation)
Data services do not commence at the time of redemption. Following redemption, a Dormant Period of up to 365 days applies. During this period, the Eligible Cardholder may activate the plan at any time of their choosing. If the plan is not activated within the Dormant Period, it will auto-activate upon expiry of the 365 days. The 15-day Validity Period begins from the date of activation. Note: Redemption does not equal activation. This structure allows cardholders to activate at the start of a trip.
Article 5 (Discount on Paid Data Plans)
In addition to the above, Eligible Cardholders may purchase paid GigSky global mobile data plans at 10-30% off the standard retail price, subject to conditions separately stipulated by GigSky. This discount applies to the following Eligible Cardholders:
- Hong Kong and Macau-issued Visa Infinite Consumer cardholders and Visa Commercial, Business and Purchasing cardholders will receive a 30% discount on all GigSky plans.
- Hong Kong and Macau-issued Visa Platinum and Visa Signature Consumer payment cardholders will receive a 20% discount on all GigSky plans.
- Hong Kong and Macau-issued Visa Classic, Visa Gold, Visa Debit and Visa Prepaid cardholders will receive a 10% discount on all GigSky plans.
Discount eligibility requires completion of card registration and verification in the GigSky App. The plans eligible for the discount and applicable conditions are subject to change at GigSky's discretion.
Article 6 (Eligibility Requirements) To participate in this Offer, all of the following conditions must be met:
- The Eligible Card is issued in the cardholder's name
- The Eligible Card account is in good standing
- Card registration and verification in the GigSky App has been completed
- The cardholder has agreed to GigSky's Terms of Service and Privacy Policy
Article 7 (Coverage) This Offer is available in 175+ countries and regions designated by GigSky. The list of available countries and regions is subject to change at GigSky's discretion without notice.
Article 8 (Disclaimers) Mobile data quality, speed, and availability may be affected by location, device, and local carrier conditions. Visa bears no responsibility for the content, quality, or availability of mobile data services. In the event of card expiry, fraudulent use, or other improper use, GigSky may suspend or cancel the Offer.
Article 9 (Relationship with Other Terms) Matters not addressed in these Terms shall be governed by the GigSky Terms of Service and Privacy Policy as separately stipulated by GigSky. In the event of any conflict between these Terms and the GigSky Terms of Service, the GigSky Terms of Service shall prevail.
Article 10 (Governing Law and Jurisdiction) The governing law and jurisdiction applicable to these Terms for Hong Kong and Macau-issued cards shall be determined separately.
