GigSky | Visa Offer

These Global Mobile Data plan options offer terms (these “Offer Terms”) apply to the promotional offer (the “Promotion”) made available to certain holders of an eligible Visa® branded credit card (an “Eligible Card”). Your redemption of any Promotional Plan (as defined below) constitutes your acceptance of these Offer Terms. You further acknowledge that any Promotional Plan continues to be subject to the standard GigSky Terms of Service (the “GigSky Terms”) and the GigSky Privacy Policy (the “Privacy Policy”) to which you have already agreed. Capitalized terms used herein but not otherwise defined herein shall have the meaning ascribed such terms under the GigSky Terms.

Definitions:

“Account Holder” or “you” means the person who has opened an account with GigSky and is eligible for this Promotion.
“Promotional Plan” means any data plans or services provided to the Account Holder pursuant to this Promotion.

Description of Promotion:

Participation in the Promotion requires that you have an Eligible Card issued in your name, that your Eligible Card account is in good standing, and that you add such Eligible Card as the default payment method in the GigSky App. 
Once you have added the Eligible Card as the default payment method in the GigSky App, you will be shown any Promotional Plans you are eligible for and you will be given the option to redeem one or more Promotional Plans.
When redeeming a Promotional Plan, the GigSky App will identify the following terms related to your Promotional Plan: the amount of included data service, eligible countries and the maximum length of the plan. Any usage above the limits outlined in the Promotional Plan will require redeeming and activating another Promotional Plan (if you are eligible) or purchasing another Service plan with GigSky.
Once redeemed, a Promotional Plan will be automatically activated once your eSIM is activated in a country covered by the Promotional Plan.
Notwithstanding the foregoing, any redeemed Promotional Plan will be automatically activated thirty (30) days following the date of redemption.

Other Terms of the Promotion:

The Promotion is solely offered by GigSky, Inc. (“GigSky”), and Visa is not providing any Promotional Plans or GigSky Products hereunder.
GigSky reserves the right to terminate your Promotional Plan if you no longer hold an Eligible Card or such Eligible Card is no longer in good standing.
GigSky reserves the right to terminate the Promotion or any Promotional Plan or change the terms of the Promotion or Promotional Plan at any time and without notice and in its sole and absolute discretion.
The Promotion is personal and non-transferable.
This Promotion cannot be combined with other discounts and/or promotions and is not redeemable for cash.
The Promotion is void where prohibited by applicable law.
GigSky reserves the right to deny you participation in the Promotion if GigSky suspects abuse or misuse of the Promotion, in its sole discretion.
You agree and acknowledge that GigSky may share your personal information with Visa and your credit card issuing bank in connection with redemption of the Promotion and use of a Promotional Plan.

PLEASE READ THE FOLLOWING CAREFULLY AND COMPLETELY. IT CONTAINS THE TERMS, CONDITIONS AND RESTRICTIONS FOR USING THE BENEFIT DESCRIBED BELOW ("TERMS AND CONDITIONS").

SUMMARY

1. What benefit is offered?

Visa Eligible Cardholders may have Access to GigSky terrestrial global mobile data service (1GB for up to 15 days) based on the Visa Eligible Card used to register to the Service, as described below (“Benefit”).

2. What are the Visa Eligible Cards?

To be considered a “Visa Eligible Card”, the payment credential must be cumulatively:

Visa Platinum, Visa Signature or Visa Infinite consumer payment credentials.
Issued by an institution that (i) follows all the applicable legislation and (ii) is a Visa payments system’s member (“Issuer”).

Issuer may elect to grant the Benefit to certain other categories of payment credentials. In such case, these Terms and Conditions also refer to those other categories of cards as "Visa Eligible Cards”.

3. Who can redeem the Benefit?

All Visa Cardholders who (i) have a Elegible Card (“Eligible Cardholder”) and (ii) don´t have an active Gigsky membership within the Gigsky Application at the time of redeeming the Benefit.

4. What services will Eligible Cardholders be able to use as part of the Benefit?

The service known as GigSky terrestrial global mobile data service - 1GB for up to 15 days ("Service").

5. Who provides the Service?

The service is provided under the full responsibility of Gigsky, Inc ("Company").

6. In which territories must a Visa Eligible Card be issued to allow an Eligible Cardholder to redeem the Benefit?

Anguilla, Antigua and Barbuda, Argentina, Bahamas, Barbados, Bermuda, Bolivia, Brazil, Cayman Islands, Chile, Colombia, Costa Rica, Dominica, Dominican Republic, Ecuador, El Salvador, Grenada, Guatemala, Guyana, Haiti, Honduras, Jamaica, Martinique, Mexico, Nicaragua, Panama, Paraguay, Peru, Saint Barthelemy, Saint Kitts and Nevis, Saint Lucia, Saint Martin, Saint Vincent and the Grenadines, Turk and Caicos Islands, Uruguay, ("Territory").

7. When can Eligible Cardholder redeem the Benefit?

From September, 2023 to November 15, 2025 ("Benefit Period").

Visa may modify the Benefit Period according to these Terms and Conditions.

Once Eligible Cardholder redeems the Benefit, the Benefit is available for a period of 15 days.

The Eligible Card Issuer may give an additional period to Eligible Cardholders enjoy the Benefit. Eligible Cardholder must check with their Issuer before redeeming the Benefit.

8. How do Eligible Cardholder access the Benefit?

Following these steps:

a. Log on to the Gigsky application through cell phone.

b. Register with Visa Eligible Card and Eligible Cardholder information.

d. Finalize registration in the Gigsky mobile application ("Gigsky Application").

Only one redemption is allowed per Eligible Cardholder and email.

9. To access the Service, what personal information and/or Personal Information must Eligible Cardholder provide to Company?

- First Name

- Last Name

- Email address

- Eligible Card number

Additionally, Eligible Cardholders with an Eligible Card issued in Mexico will need to provide the number of Visa Eligible Card that is a physical payment credential (but not the number of the digital payment credential associated with that physical card).

10. How will Visa use Personal Information?

Visa will use the personal account number (16-digit payment card number) only to validate Cardholder eligibility and according to the Visa Privacy Notice found at:

SERVICES DETAILS

A. Acceptance. By redeeming the Benefit, Eligible Cardholder is accepting these Terms and Conditions, as well as any other terms, conditions and restrictions specific to the Benefi, which Visa discloses in any communication, including, but not limited to via posting on websites or Visa social media accounts.

B. Changes. Visa reserves the right to change these Terms and Conditions in any way, including, without limitation: (i) discontinuing Benefits; (ii) changing the Benefit; and (iii) any other changes to protect Visa interests or under circumstances that, in Visa´s judgment, present abuse or fraud.

C. Redemption Limits. Only one redemption is permitted per Eligible Card per email account.

D. Does not apply to the Service. These Terms and Conditions do not govern your use of the Service or the Service Portal. The Service and the Service Portal are subject to certain terms, conditions and restrictions ("Terms of Service") which can be found in the Service Portal. To use the Service and enjoy the Benefit, Eligible Cardholder must agree to the Terms of Service.

E. Links. The Visa Benefit Portal contains links, including, without limitation, to the Service Portal. When Eligible Cardholder clicks on such links, Eligible Cardholder will be leaving the Visa Benefits Portal and entering web pages not controlled by Visa, such as the Service Portal.

F. Company Materials. The Company, not Visa, creates and controls: (i) the Service; (ii) the Terms of Service and (iii) the Service Portal (collectively, items i-iii, the "Company Materials"). Eligible Cardholders acknowledge and agree that Visa has no control over or interference with, or responsibility for, the Company Materials.

G. Personal Information. In order to provide the Benefit, Visa and the Company may share Personal Information to each other. The use of such information is governed, in the case of the Company, by the Company Policy and, in the case of Visa, by the Visa Policy. By redeeming the Benefit, Eligible Cardholder acknowledges that have had the opportunity to read, and have agreed to, the Company Policy and the Visa Policy. Visa is authorized to send, transmit and store Personal Information outside my country of residence. That is, you expressly authorize Visa to (i) send and transmit information that pertains to you and/or identifies you anywhere in the world (ii) store such information anywhere in the world.

H. Limitation of Liability.

VISA IS NOT LIABLE FOR: (i) COMPANY MATERIALS; (ii) ANY CONTENT OR OTHER MATERIALS HOSTED AND OFFERED BY THE SERVICE OR THE SERVICE PORTAL; AND (iii) COMPANY'S USE OF INFORMATION COLLECTED BY COMPANY, INCLUDING, WITHOUT LIMITATION, THROUGH THE SERVICE OR THE SERVICE PORTAL (SUCH AS, FOR EXAMPLE, PERSONAL INFORMATION).

VISA IS NOT RESPONSIBLE FOR TECHNICAL INCONVENIENTS OUT OF ITS CONTROL THAT MAKE VISA BENEFIT PORTAL TEMPORARILY UNAVAILABLE.

THE ISSUER IS NOT RESPONSIBLE FOR EITHER THE BENEFIT OR COMPANY MATERIALS. TO, THE COMPANY.

VISA IS NOT LIABLE FOR ANY DIRECT LOSS OR DAMAGES RESULTING FROM: (I) COMPANY´S REFUSAL TO ALLOW ELIGIBLE CARDHOLDER TO ACESS OR REDEEM THE BENEFIT; (II) THE DISCONTINUATION OR MODIFICATION OF THE BENEFIT; (III) ANY FAILURE OR INABILITY FOR ANY REASON ON THE PART OF WHOEVER ACCESSES OR USES THE BENEFIT; OR (IV) THE PROVISION OF THE SERVICE.

IN NO EVENT SHALL VISA, ITS SUCCESSORS AND ASSIGNS, AND EACH OF THEIR RESPECTIVE INVESTORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS AND SUPPLIERS (INCLUDING DISTRIBUTORS AND CONTENT LICENSORS) BE LIABLE FOR ANY DIRECT, INDIRECT OR PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE BENEFIT OR SERVICE, REGARDLESS OF THE LEGAL THEORY ON WHICH SUCH DAMAGES ARE BASED, EVEN IF VISA HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS OUR LIABILITY THAT MAY NOT BE LIMITED UNDER THE LAW APPLICABLE TO THESE TERMS AND CONDITIONS.

I. Upon Termination of the Benefit. Upon termination of the Benefit Period, and unless Eligible Cardholder cancel the subscription to the Service prior to the end of the Benefit Period, Eligible Cardholder will automatically become a subscriber to the Service, directly with the Company, and subject to the Terms of Service, obligating you to pay the full value of the Service.

J. Cost to Eligible Person; Value of Benefit. The Benefit is free of charge to the Eligible Cardholder.

K. Warranties. Eligible Cardholder will use the Benefits for lawful purposes only and will not violate the laws, regulations, ordinances or other requirements of any central, state, local government or any international law. Unauthorized use of the Benefit (1) allows Visa to claim damages against Eligible Cardholder and/or (2) may constitute a crime. Eligible Cardholder will use the Benefits solely for personal and non-commercial uses.

L. As Is. Eligible Cardholder understands and agrees that the Benefit is provided "as is" with "defects" and on an "as available" basis. Eligible Cardholder agrees that the use of the Benefit and the Service is at Eligible Cardholder sole risk. All warranties including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement are disclaimed and excluded. Visa makes no representations or warranties of any kind, either express or implied and expressly disclaims any and all representations and warranties as to (a) accuracy, adequacy, reliability, completeness, suitability or applicability of the information, content, data, products and/or services, merchantability or any warranty of fitness for a particular purpose; (b) that the Benefit or Service will be uninterrupted, timely, secure and error-free and any deficiencies, errors, defects or nonconformities will be corrected; (c) the quality of the Service, content, information, data or other material in the Company Materials and on the Visa Benefit Portal will meet Eligible Cardholder expectations or requirements; (d) any errors in the Visa Benefit Portal will be corrected; (e) warranties against infringement of any intellectual property or proprietary rights of third parties; or (f) other warranties relating to the performance, nonperformance or other acts of omission by Visa, its officers, directors, employees, agents, licensors or suppliers.

M. Severability. The provisions of these Terms and Conditions are severable, and the invalidity in whole or in part of any provision shall not affect the validity of the remaining provisions.

N. Law and Dispute Resolution. These Terms and Conditions are governed by the laws of New York and the exclusive jurisdiction of the courts of New York shall apply.

5. ¿Quién proporciona el Servicio?

El servicio se proporciona bajo la total responsabilidad de Gigsky, Inc ("Compañía").

6. ¿En qué territorios se debe emitir una Tarjeta Elegible Visa para permitir que un Titular de Tarjeta Elegible canjee el Beneficio?

Anguila, Antigua y Barbuda, Argentina, Bahamas, Barbados, Bermudas, Bolivia, Brasil, Islas Caimán, Chile, Colombia, Costa Rica, Dominica, República Dominicana, Ecuador, El Salvador, Granada, Guatemala, Guyana, Haití, Honduras, Jamaica, Martinica, México, Nicaragua, Panamá, Paraguay, Perú, San Bartolomé, San Cristóbal y Nieves, Santa Lucía, San Martín, San Vicente y las Granadinas, Islas Turcas y Caicos, Uruguay, ("Territorio").

7. ¿Cuándo puede el Titular de la Tarjeta Elegible canjear el Beneficio?

Desde septiembre de 2023 hasta el 15 de noviembre de 2025 (“Período de Beneficios”).

Visa podrá modificar el Período de Beneficios de acuerdo con estos Términos y Condiciones.

Una vez que el Titular de la tarjeta elegible canjea el Beneficio, el Beneficio está disponible por un período de 15 días.

El Emisor de la Tarjeta Elegible podrá otorgar un período adicional para que los Titulares de Tarjetas Elegibles disfruten del Beneficio. El titular de la tarjeta elegible debe consultar con su emisor antes de canjear el beneficio.

8. ¿Cómo accede el Titular de la Tarjeta Elegible al Beneficio?

b. Regístrese con la información de la tarjeta elegible Visa y del titular de la tarjeta elegible.

d. Finalizar el registro en la aplicación móvil Gigsky (“Aplicación Gigsky”).

Solo se permite un canje por titular de tarjeta elegible y correo electrónico.

9. Para acceder al Servicio, ¿qué información personal y/o Información Personal debe proporcionar el Titular de la Tarjeta Elegible a la Compañía?

- Dirección de correo electrónico

- Número de tarjeta elegible

Además, los titulares de tarjetas elegibles con una tarjeta elegible emitida en México deberán proporcionar el número de tarjeta elegible Visa que es una credencial de pago física (pero no el número de la credencial de pago digital asociada con esa tarjeta física).

10. ¿Cómo utilizará Visa la información personal?

DETALLES DE LOS SERVICIOS

R. Aceptación. Al canjear el Beneficio, el Titular de la tarjeta elegible acepta estos Términos y condiciones, así como cualquier otro término, condición y restricción específicos del Beneficio, que Visa divulga en cualquier comunicación, incluidas, entre otras, publicaciones en sitios web o redes sociales de Visa. cuentas.

B. Cambios. Cuando el Titular de tarjeta elegible hace clic en dichos enlaces, el Titular de tarjeta elegible abandonará el Portal de beneficios de Visa e ingresará a páginas web no controladas por Visa, como el Portal de servicios.

F. Materiales de la empresa. La Compañía, no Visa, crea y controla: (i) el Servicio; (ii) los Términos de Servicio y (iii) el Portal de Servicio (colectivamente, puntos i-iii, los "Materiales de la Compañía"). Los titulares de tarjetas elegibles reconocen y aceptan que Visa no tiene control ni interferencia ni responsabilidad sobre los Materiales de la empresa.

G. Información personal. Para brindar el Beneficio, Visa y la Compañía pueden compartir Información personal entre sí. El uso de dicha información se rige, en el caso de la Compañía, por la Política de la Compañía y, en el caso de Visa, por la Política de Visa. Al canjear el Beneficio, el Titular de la tarjeta elegible reconoce que ha tenido la oportunidad de leer y ha aceptado la Política de la empresa y la Política de Visa. Visa está autorizada a enviar, transmitir y almacenar Información Personal fuera de mi país de residencia. Es decir, usted autoriza expresamente a Visa a (i) enviar y transmitir información que le pertenece y/o lo identifica en cualquier parte del mundo (ii) almacenar dicha información en cualquier parte del mundo.

H. Limitación de responsabilidad.

VISA NO ES RESPONSABLE DE: (i) MATERIALES DE LA COMPAÑÍA; (ii) CUALQUIER CONTENIDO U OTROS MATERIALES ALOJADOS Y OFRECIDOS POR EL SERVICIO O EL PORTAL DE SERVICIO; Y (iii) EL USO POR PARTE DE LA COMPAÑÍA DE LA INFORMACIÓN RECOPILADA POR LA COMPAÑÍA, INCLUYENDO, SIN LIMITACIÓN, A TRAVÉS DEL SERVICIO O DEL PORTAL DE SERVICIO (TALES COMO, POR EJEMPLO, INFORMACIÓN PERSONAL).

VISA NO ES RESPONSABLE POR INCONVENIENTES TÉCNICOS FUERA DE SU CONTROL QUE HAGAN QUE EL PORTAL DE BENEFICIOS DE VISA NO ESTÉ DISPONIBLE TEMPORALMENTE.

EL EMISOR NO ES RESPONSABLE NI DEL BENEFICIO NI DE LOS MATERIALES DE LA COMPAÑÍA. A LA COMPAÑIA.

VISA NO ES RESPONSABLE POR NINGUNA PÉRDIDA O DAÑO DIRECTO QUE RESULTE DE: (I) LA NEGACIÓN DE LA COMPAÑÍA A PERMITIR QUE EL TITULAR DE LA TARJETA ELEGIBLE ACCEDA O CANJEE EL BENEFICIO; (II) LA DISCONTINUACIÓN O MODIFICACIÓN DEL BENEFICIO; (III) CUALQUIER FALLA O INCAPACIDAD POR CUALQUIER CAUSA DE QUIEN ACCEDE O UTILIZA EL BENEFICIO; O (IV) LA PRESTACIÓN DEL SERVICIO.

EN NINGÚN CASO VISA, SUS SUCESORES Y CESIONARIOS, Y CADA UNO DE SUS RESPECTIVOS INVERSIONISTAS, DIRECTORES, FUNCIONARIOS, EMPLEADOS, AGENTES Y PROVEEDORES (INCLUYENDO DISTRIBUIDORES Y LICENCIANTES DE CONTENIDO) SERÁN RESPONSABLES DE CUALQUIER DAÑO DIRECTO, INDIRECTO O PUNITIVO, INCIDENTAL, ESPECIAL O CONSECUENTE QUE SURJAN DEL USO DEL BENEFICIO O SERVICIO O ESTÉN RELACIONADOS DE ALGÚN MODO CON EL USO, INDEPENDIENTEMENTE DE LA TEORÍA JURÍDICA EN LA QUE SE BASAN DICHOS DAÑOS, INCLUSO SI VISA HA SIDO INFORMADA DE LA POSIBILIDAD DE DAÑOS.

NADA EN ESTOS TÉRMINOS Y CONDICIONES EXCLUYE O LIMITA NUESTRA RESPONSABILIDAD QUE NO PUEDE SER LIMITADA SEGÚN LA LEY APLICABLE A ESTOS TÉRMINOS Y CONDICIONES.

I. Por Terminación del Beneficio. Al finalizar el Período de beneficios, y a menos que el Titular de la tarjeta elegible cancele la suscripción al Servicio antes del final del Período de beneficios, el Titular de la tarjeta elegible se convertirá automáticamente en suscriptor del Servicio, directamente con la Compañía y sujeto a los Términos de servicio. obligándole a pagar el valor total del Servicio.

J. Costo para la persona elegible; Valor del beneficio. El Beneficio es gratuito para el Titular de la Tarjeta Elegible.

K. Garantías. El Titular de la Tarjeta Elegible utilizará los Beneficios únicamente para fines legales y no violará las leyes, regulaciones, ordenanzas u otros requisitos de ningún gobierno central, estatal, local o cualquier ley internacional. El uso no autorizado del Beneficio (1) permite a Visa reclamar daños y perjuicios al Titular de la tarjeta elegible y/o (2) puede constituir un delito. El Titular de la Tarjeta Elegible utilizará los Beneficios únicamente para usos personales y no comerciales.

L. Tal cual. El Titular de la tarjeta elegible comprende y acepta que el Beneficio se proporciona "tal cual", con "defectos" y "según disponibilidad". El Titular de la Tarjeta Elegible acepta que el uso del Beneficio y el Servicio es por cuenta y riesgo exclusivo del Titular de la Tarjeta Elegible. Se rechazan y excluyen todas las garantías, incluidas, entre otras, las garantías de comerciabilidad, idoneidad para un propósito particular y no infracción. El servicio será ininterrumpido, oportuno, seguro y libre de errores y se corregirá cualquier deficiencia, error, defecto o no conformidad; (c) la calidad del Servicio, contenido, información, datos u otro material en los Materiales de la Compañía y en el Portal de Beneficios de Visa cumplirá con las expectativas o requisitos del Titular de Tarjeta Elegible; (d) se corregirá cualquier error en el Portal de Beneficios de Visa; (e) garantías contra la infracción de cualquier propiedad intelectual o derechos de propiedad de terceros; u (f) otras garantías relacionadas con el desempeño, incumplimiento u otros actos de omisión por parte de Visa, sus funcionarios, directores, empleados, agentes, licenciantes o proveedores.

M. Divisibilidad. Las disposiciones de estos Términos y condiciones son divisibles y la invalidez total o parcial de cualquier disposición no afectará la validez de las disposiciones restantes.

N. Derecho y Resolución de Controversias. Estos Términos y Condiciones se rigen por las leyes de Nueva York y se aplicará la jurisdicción exclusiva de los tribunales de Nueva York.

1. Qual benefício é oferecido?

Os Portadores de Cartões Visa Elegíveis podem ter acesso ao serviço de dados móveis globais terrestres GigSky (1 GB por até 15 dias) com base no Cartão Visa Elegível usado para registrar-se no Serviço, conforme descrito abaixo (“Benefício”).

2. Quais são os Cartões Visa Elegíveis?

Para ser considerado um “Cartão Visa Elegível”, o cartão de pagamento deverá ser cumulativamente:

Credencial de pagamento Visa Platinum, Visa Signature ou Visa Infinite.
Emitido por instituição que (i) siga toda a legislação aplicável e (ii) seja membro dos arranjos de pagamentos da Visa (“Emissor”).
Ativo, ou seja, realizou pelo menos uma transação nos 3 (três) meses anteriores à intenção de utilização do Benefício.

O Emissor poderá optar por conceder o Benefício a determinadas outras categorias de credenciais de pagamento. Nesse caso, estes Termos e Condições também se referem a essas outras categorias de cartões como “Cartões Visa Elegíveis”.

3. Quem pode resgatar o Benefício?

Todos os Portadores de Cartão Visa que (i) possuem um Cartão Elegível (“Portador do Cartão Elegível”) e (ii) não possuem uma associação Gigsky ativa no aplicativo Gigsky no momento do resgate do Benefício.

4. Quais serviços os Portadores do Cartão Elegíveis poderão utilizar como parte do Benefício?

O serviço conhecido como serviço de dados móveis globais terrestres GigSky - 1GB por até 15 dias (“Serviço”).

5. Quem fornece o Serviço?

O serviço é prestado sob total responsabilidade da Gigsky, Inc ("Empresa").

6. Em quais territórios um Cartão Visa Elegível deve ser emitido para permitir que um Portador de Cartão Elegível resgate o Benefício?

Anguila, Antígua e Barbuda, Bahamas, Barbados, Bermudas, Bolívia, Brasil, Ilhas Cayman, Chile, Colômbia, Costa Rica, Dominica, República Dominicana, Equador, El Salvador, Granada, Guatemala, Guiana, Haiti, Honduras, Jamaica, Martinica, México, Nicarágua, Panamá, Paraguai, Peru, São Bartolomeu, São Cristóvão e Nevis, Santa Lúcia, São Martinho, São Vicente e Granadinas, Ilhas Turcas e Caicos, Uruguai, ("Território").

7. Quando o Portador do Cartão Elegível pode resgatar o Benefício?

De setembro de 2023 a 15 de novembro de 2025 (“Período do Benefício”).

A Visa poderá modificar o Período do Benefício de acordo com estes Termos e Condições.

Assim que o Portador Elegível resgatar o Benefício, o Benefício estará disponível por um período de 15 dias.

O Emissor do Cartão Elegível poderá conceder um período adicional para que os Portadores do Cartão Elegível usufruam do Benefício. O Portador do Cartão Elegível deverá verificar com seu Emissor antes de resgatar o Benefício.

8. Como o Portador Elegível acessa o Benefício?

Seguindo estas etapas:

a. Faça login no aplicativo Gigsky pelo celular.

b. Cadastre-se com as informações do Cartão Visa Elegível e do Portador do Cartão Elegível.

c. Finalize o cadastro no aplicativo móvel Gigsky (“Aplicativo Gigsky”).

Somente um resgate é permitido por Portador de Cartão Elegível e e-mail.

9. Para acessar o Serviço, quais informações pessoais e/ou Informações Pessoais o Portador do Cartão Elegível deve fornecer à Empresa?

- Primeiro nome

- Sobrenome

- Endereço de e-mail

- Número do Cartão Elegível

Além disso, os Portadores de Cartão Elegível com um Cartão Elegível emitido no México precisarão fornecer o número do Cartão Visa Elegível que é uma credencial de pagamento física (mas não o número da credencial de pagamento digital associada a esse cartão físico).

10. Como a Visa utilizará as Informações Pessoais?

A Visa utilizará o número da conta pessoal (número da credencial de pagamento de 16 dígitos) apenas para validar a elegibilidade do Portador do cartão e de acordo com o Aviso de Privacidade da Visa encontrado em:

DETALHES DOS SERVIÇOS

A. Aceitação. Ao resgatar o Benefício, o Portador do Cartão Elegível está aceitando estes Termos e Condições, bem como quaisquer outros termos, condições e limitações específicas do Benefício, o qual a Visa divulga em qualquer comunicação, incluindo, mas não limitado a, através de publicação em sites ou mídias sociais da Visa.

B. Mudanças. A Visa reserva-se o direito de alterar estes Termos e Condições de qualquer forma, incluindo, sem limitação: (i) descontinuação dos Benefícios; (ii) alteração do Benefício; e (iii) quaisquer outras alterações para proteger os interesses da Visa ou sob circunstâncias que, sob o julgamento da Visa, apresentem abuso ou fraude.

C. Limites de Resgate. Somente um resgate é permitido por Cartão Elegível e por conta de e-mail.

D. Não se aplica ao Serviço. Estes Termos e Condições não regem o uso do Serviço ou do Portal de Serviços. O Serviço e o Portal de Serviços estão sujeitos a determinados termos, condições e limitações ("Termos de Serviço") que podem ser encontrados no Portal de Serviços. Para usar o Serviço e aproveitar o Benefício, o Portador do Cartão Elegível deve concordar com os Termos de Serviço.

E. Links. O Portal de Benefícios Visa contém links, incluindo, sem limitação, para o Portal de Serviços. Quando o Portador do Cartão Elegível clicar em tais links, o Portador do Cartão Elegível sairá do Portal de Benefícios Visa e entrará em páginas da web não controladas pela Visa, como o Portal de Serviços.

F. Materiais da Empresa. A Empresa, e não a Visa, cria e controla: (i) o Serviço; (ii) os Termos de Serviço e (iii) o Portal de Serviços (coletivamente, itens i-iii, os “Materiais da Empresa”). Os Portadores de Cartão Elegíveis reconhecem e concordam que a Visa não tem controle, interferência ou responsabilidade pelos Materiais da Empresa.

G. Informações Pessoais. Para fornecer o Benefício, a Visa e a Empresa poderão compartilhar Informações Pessoais entre si. O uso de tais informações é regido, no caso da Empresa, pela Política da Empresa e, no caso da Visa, pela Política da Visa. Ao resgatar o Benefício, o Portador Elegível do Cartão reconhece que teve a oportunidade de ler e concordou com a Política da Empresa e a Política da Visa. A Visa está autorizada a compartilhar, transmitir e armazenar Informações Pessoais fora do seu país de residência. Ou seja, você autoriza expressamente a Visa a (i) enviar e transferir informações que lhe digam respeito e/ou que o identifique em qualquer lugar do mundo (ii) armazenar tais informações em qualquer lugar do mundo.

H. Limitação de Responsabilidade.

A VISA NÃO É RESPONSÁVEL POR: (i) MATERIAIS DA EMPRESA; (ii) QUALQUER CONTEÚDO OU OUTROS MATERIAIS HOSPEDADOS E OFERECIDOS PELO SERVIÇO OU PORTAL DE SERVIÇO; E (iii) USO PELA EMPRESA DE INFORMAÇÕES COLETADAS PELA EMPRESA, INCLUINDO, SEM LIMITAÇÃO, ATRAVÉS DO SERVIÇO OU DO PORTAL DE SERVIÇO (TAIS COMO, POR EXEMPLO, INFORMAÇÕES PESSOAIS).

A VISA NÃO SE RESPONSABILIZA POR INCONVENIENTES TÉCNICOS FORA DE SEU CONTROLE QUE TORNEM O PORTAL DE BENEFÍCIOS VISA TEMPORARIAMENTE INDISPONÍVEL.

O EMISSOR NÃO É RESPONSÁVEL NEM PELO BENEFÍCIO NEM PELOS MATERIAIS DA EMPRESA.

A VISA NÃO SE RESPONSABILIZA POR QUAISQUER PERDAS OU DANOS DIRETOS RESULTANTES DE: (I) RECUSA DA EMPRESA EM PERMITIR QUE O PORTADOR ELEGÍVEL ACESSE OU RESGATE O BENEFÍCIO; (II) A DESCONTINUAÇÃO OU MODIFICAÇÃO DO BENEFÍCIO; (III) QUALQUER FALHA OU INCAPACIDADE POR QUALQUER MOTIVO POR PARTE DE QUEM ACESSA OU UTILIZA O BENEFÍCIO; OU (IV) A PRESTAÇÃO DO SERVIÇO.

EM HIPÓTESE ALGUMA A VISA, SEUS SUCESSORES E CESSIONÁRIOS, E CADA UM DE SEUS RESPECTIVOS INVESTIDORES, DIRETORES, OFICIAIS, FUNCIONÁRIOS, AGENTES E FORNECEDORES (INCLUINDO DISTRIBUIDORES E LICENCIADORES DE CONTEÚDO) SERÃO RESPONSÁVEIS POR QUAISQUER DANOS DIRETOS, INDIRETOS OU PUNITIVOS, INCIDENTAIS, ESPECIAIS, CONSEQUENCIAIS DECORRENTE DE OU DE QUALQUER FORMA RELACIONADO COM O USO DO BENEFÍCIO OU SERVIÇO, INDEPENDENTEMENTE DA TEORIA JURÍDICA EM QUE TAIS DANOS SE BASEAM, MESMO QUE A VISA TENHA SIDO AVISADA DA POSSIBILIDADE DE DANOS.

NADA NESTES TERMOS E CONDIÇÕES EXCLUI OU LIMITA A NOSSA RESPONSABILIDADE QUE NÃO PODE SER LIMITADA SOB A LEI APLICÁVEL A ESTES TERMOS E CONDIÇÕES.

I. Ao Término do Benefício. Após o término do Período do Benefício, e a menos que o Portador do Cartão Elegível cancele a assinatura do Serviço antes do final do Período do Benefício, o Portador do Cartão Elegível se tornará automaticamente um assinante do Serviço, diretamente com a Empresa e sujeito aos Termos de Serviço, obrigando você a pagar o valor total do Serviço.

J. Custo para Pessoa Elegível; Valor do Benefício. O Benefício é gratuito para o Portador do Cartão Elegível. A gratuidade do Benefício será durante o Período do Benefício e não se confunde com eventuais valores aplicáveis ao Serviço após o Término do Benefício.

K. Garantias. O Portador do Cartão Elegível usará os Benefícios apenas para fins legais e não violará as leis, regulamentos, portarias ou outros requisitos de qualquer governo federal, estadual, local ou qualquer lei internacional. O uso não autorizado do Benefício (1) permite que a Visa reivindique danos contra o Portador do Cartão Elegível e/ou (2) pode constituir um crime. O Portador do Cartão Elegível usará os Benefícios exclusivamente para uso pessoal e não comercial.

L. Como está. O Portador do Cartão Elegível entende e concorda que o Benefício é fornecido “no estado em que se encontra”, com “defeitos” e “conforme disponível”. O Portador do Cartão Elegível concorda que o uso do Benefício e do Serviço é de risco exclusivo do Portador do Cartão Elegível. Todas as garantias, incluindo, sem limitação, as garantias de comercialização, adequação a uma finalidade específica e não violação, são rejeitadas e excluídas. A Visa não faz declarações ou garantias de qualquer tipo, expressas ou implícitas, e se isenta expressamente de toda e qualquer declaração e garantia quanto a (a) exatidão, adequação, confiabilidade, integridade, adequação ou aplicabilidade das informações, conteúdo, dados, produtos e/ou ou serviços, comercialização ou qualquer garantia de adequação a uma finalidade específica; (b) que o Benefício ou Serviço será ininterrupto, oportuno, seguro e livre de erros e quaisquer deficiências, erros, defeitos ou não conformidades serão corrigidos; (c) a qualidade do Serviço, conteúdo, informações, dados ou outro material nos Materiais da Empresa e no Portal de Benefícios Visa atenderá às expectativas ou requisitos do Portador do Cartão Elegível; (d) quaisquer erros no Portal de Benefícios Visa serão corrigidos; (e) garantias contra violação de qualquer propriedade intelectual ou direitos de propriedade de terceiros; ou (f) outras garantias relacionadas ao desempenho, não cumprimento ou outros atos de omissão por parte da Visa, de seus executivos, diretores, funcionários, agentes, licenciantes ou fornecedores.

M. Divisibilidade. As disposições destes Termos e Condições são divisíveis, e a invalidade total ou parcial de qualquer disposição não afetará a validade das restantes disposições.

N. Lei e resolução de disputas. Estes Termos e Condições são regidos pelas leis do Brasil e será aplicada a jurisdição exclusiva dos tribunais de São Paulo.
